Privacy Policy (Personal Information Protection Policy)

Unique Journey (the "Operator") issues this Privacy Policy (the "Policy") concerning the handling of personal information of individuals who use the BeFam service (the "Service") (each, a "User"). The Operator establishes appropriate systems for the protection of personal information and is committed to safeguarding the privacy of all Users.

Article 1 Fundamental Approach

The Operator collects personal information only to the extent necessary for the smooth provision of the Service.

In this Policy, "personal information" has the meaning set out in the Act on the Protection of Personal Information (Act No. 57 of 2003 of Japan) and refers to information relating to a living individual that can identify that individual, including by name, date of birth, or other description; information that can be readily collated with other information to enable identification of a specific individual; or information containing a personal identifier.

Article 2 Collection of Personal Information

The Operator collects personally identifiable information (such as name, address, date of birth, telephone number, and email address) in the following circumstances:

1. when a User provides or posts information containing personal data for the purpose of using the Service;

2. when a User submits personal information in connection with an enquiry or an application for a Match.

Article 3 Purpose of Use

1. The Operator uses collected personal information only for the purposes necessary to perform the following operations. If the Operator wishes to use personal information beyond those purposes, it will obtain the prior consent of the User by an appropriate method.

(a) to provide, operate and manage the Service;

(b) to inform Users of new functions, campaigns or other features of the Operator's services;

(c) to contact Users as necessary in relation to maintenance or similar matters;

(d) to respond to comments, enquiries or other communications from Users concerning the Service;

(e) to identify Users who breach the Service Terms or who use the Service for improper or unlawful purposes, and to refuse use of the Service by such Users.

2. The Operator may change a purpose of use where the new purpose is reasonably related to the original purpose.

3. If the purpose of use is changed, the Operator will notify Users by a method prescribed by the Operator and will also publish the change on its website.

Article 4 Disclosure to Third Parties

Except in the cases set out below, the Operator will not disclose or provide personal information obtained through the Service to any third party without the User's consent:

1. where necessary to protect life, body or property and obtaining consent is difficult;

2. where cooperation with a national or local government agency is required to perform statutory duties and obtaining consent may hinder that performance;

3. where handling of personal information is outsourced, in whole or in part, to the extent necessary for business operations;

4. where personal information is jointly used with a specified party and the Operator has notified Users in advance—or has made readily available—the items of personal information jointly used, the scope of joint users, their purposes of use and the name of the party responsible for management;

5. where personal information is provided in connection with a business succession due to merger or other transaction.

Article 5 Security Measures

1. The Operator strives to keep personal information accurate and up to date and manages it strictly, taking appropriate security measures.

2. For system maintenance or similar purposes, the Operator may outsource operations that involve handling personal information. In that case the Operator will ensure the contractor takes necessary measures to prevent leakage or other incidents.

Article 6 Access, Correction, Deletion and Cessation of Use

1. Upon a request from a User, the Operator will disclose without delay the personal information held about that User except where disclosure would:

(a) endanger the life, body, property or other rights or interests of the User or a third party;

(b) significantly impede the proper conduct of the Operator's business; or

(c) contravene any law or regulation.

The Operator will notify the User without delay if any part of the information cannot be disclosed.

2. If personal information held by the Operator is incorrect, the Operator will, upon request by the User and in accordance with procedures prescribed by the Operator, correct or delete the information.

3. Where the Operator determines that such a request should be honoured, it will correct or delete the information without delay and notify the User accordingly.

4. If a User requests the cessation of use or erasure of personal information (collectively "Cessation of Use") on any of the following grounds, the Operator will investigate without delay and, in accordance with law, effect Cessation of Use and notify the User. Where Cessation of Use would involve disproportionate cost or is otherwise difficult, the Operator may take alternative measures to protect the User's interests. Grounds include:

(a) use beyond the stated purpose;

(b) acquisition by improper means;

(c) use that may encourage or induce illegal or improper acts;

(d) the Operator no longer needs to use the information;

(e) leakage or potential leakage resulting from unauthorised access, ransomware attack or similar act;

(f) use that may infringe the rights or interests of the User.

5. A User wishing to request disclosure, correction, addition, deletion, Cessation of Use, or cessation of provision to third parties, should send the documents listed below to the contact in Article 9. Disclosure will be provided either electronically or in hard copy, as the User specifies.

• JPY 800 (excl. GST) per request, payable by the method specified by the Operator.

Article 7 Amendment of Policy

Except as otherwise required by law or stated in this Policy, the Operator may amend this Policy. Amendments take effect when the Operator notifies Users by a method prescribed by the Operator or publishes the amended Policy on its website.

Article 8 Complaints and Enquiries

The Operator will establish the contact point in Article 9 to receive and respond promptly and appropriately to complaints and enquiries from Users regarding the handling of personal information.
